General Conditions of Sale

These general conditions of sale are entered into, on the one hand, by the company MONCONFORT with a share capital of 5,000,000 CFA francs, headquartered in Abidjan, registered with the Trade and Companies Register of Côte d'Ivoire under number CI – ABIJ – B 11422, hereinafter referred to as "MONCONFORT," managing the website www.monconfort.ci, and, on the other hand, by any natural or legal person wishing to make a purchase through the website www.monconfort.ci, hereinafter referred to as "the buyer."

Article 1. Purpose

These general conditions of sale aim to define the contractual relationship between MONCONFORT and the buyer and the conditions applicable to any purchase made through the website www.monconfort.ci. The acquisition of a product through this site implies an unconditional acceptance by the buyer of these general conditions of sale, which the buyer acknowledges having read before placing an order. Before any transaction, the buyer declares, on the one hand, that the purchase of products on the site www.monconfort.ci is unrelated to his professional activity and is limited to strictly personal use, and, on the other hand, that he has full legal capacity, allowing him to commit to these general conditions of sale.

MONCONFORT reserves the right to modify these sales conditions at any time to comply with new regulations or to improve the use of its site. Therefore, the applicable conditions will be those in effect on the date of the order by the buyer.

Article 2. Products

The products offered are those listed on the website www.monconfort.ci of the company MONCONFORT, within the limits of available stocks. MONCONFORT reserves the right to modify the range of products at any time. Each product is presented on the website in the form of a description outlining its main technical characteristics (capacity, use, composition, etc.). The photographs are as faithful as possible but do not bind the Seller in any way. The sale of products presented on the site www.monconfort.ci is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

Article 3. Prices

The prices on the product sheets of the internet catalog are in CFA francs, all taxes included (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. MONCONFORT reserves the right to change its prices at any time, provided that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased based on the total amount of the order.

Article 4. Order and Payment Terms

Before placing an order, it is recommended that the buyer create an account on the site www.monconfort.ci. The account creation section is accessible directly from the side menu bar. On each visit, if the buyer wishes to place an order or check his account (order status, profile, etc.), he must identify himself using this information. Confirmation of an order implies acceptance of these general conditions of sale, acknowledgment of having perfect knowledge of them, and waiver of relying on one's own terms of purchase. All data provided and the recorded confirmation will constitute proof of the transaction. If the buyer has an email address and has provided it on his order form, MONCONFORT will communicate to him by email the confirmation of the registration of his order.

Article 5. Retention of Ownership

MONCONFORT retains full ownership of the products sold until the full payment of the price, including principal, costs, and taxes.

Article 6: Product Return Condition

Your return will not be accepted if your product is not complete. Each product will be subject to examination. If, after our diagnosis, the product:

It will be replaced with a new one within the limits of available stock or refunded by a voucher. For defective products under warranty after 10 days, contact the after-sales service directly; the invoice will be systematically requested when depositing the item for repair.

If the defect is the fault of the user, the product will be returned to him. Warranties only cover technical failures and do not include accessories.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed-upon geographical area. Orders are fulfilled by a delivery service with tracking. Delivery times are given for indicative purposes only; if they exceed thirty days from the order, the sales contract may be terminated, and the buyer refunded. The risks associated with transportation are the responsibility of the buyer from the moment the items leave the premises of MONCONFORT. The buyer is required to check, in the presence of the postal worker or delivery person, the condition of the packaging of the goods and its content upon delivery. In case of damage during transport, any protest must be made within three days from the delivery.

Article 8. Warranty

All products supplied by MONCONFORT benefit from a six (06)-month warranty. In the event of non-compliance with a sold product, it may be returned to MONCONFORT, which will take it back, exchange it, or refund it. All claims, requests for exchange, or refund must be made within seven (07) days after delivery.

Article 9. Liability

MONCONFORT, in the process of distance selling, is only bound by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network, such as data loss, intrusion, viruses, service interruption, or other involuntary problems.

In the case of credit payment, the buyer would be required to take care of the product. In case of theft or loss, MONCONFORT will collect the remaining balance of the product price according to the established schedule. However, in the event of loss or theft of the product, the buyer is required to inform MONCONFORT within 3 days, either in writing, by email, by phone, or by any other means.

Article 10. Intellectual Property

All elements of the site www.monconfort.ci are and remain the intellectual property and exclusive ownership of the company MONCONFORT. No one is authorized to reproduce, exploit, or use in any way, even partially, elements of the site, whether in the form of a photo, logo, visual, or text.

Article 11. Personal Data

MONCONFORT undertakes to preserve the confidentiality of the information provided by the buyer, which he may transmit for the use of certain services. In this regard, the Internet user has the right to access, modify, and delete information about him. He can make this request at any time by email to the following address: dcm@monconfort.ci.

Article 12. Settlement of Disputes

These distance selling conditions are subject to Ivorian law. For any disputes or litigation, the competent court will be that of Abidjan in case amicable resolution remains unsuccessful within a period of thirty (30) days.
